End User License Agreement

Please read this agreement carefully before installing or using Sports Video Basic. By installing, downloading, or using the software, you agree to be bound by the terms of this agreement. If you do not agree, do not install or use the software.
1. Parties
This End User License Agreement ("Agreement") is between you ("Licensee" or "you") and TNKR ("Licensor", "we", or "us"), the developer of Sports Video Basic (the "Software").
2. Grant of License
Subject to the terms of this Agreement and payment of the applicable subscription fee, the Licensor grants you a limited, non-exclusive, non-transferable, revocable license to:
- Install and use the Software on a single computer that you own or control
- Use the Software solely for your personal or internal business purposes
This license does not grant you any ownership rights in the Software.
3. Subscription and License Keys
3.1 Annual Subscription
Access to the Software requires an active annual subscription. Your subscription renews automatically each year unless cancelled. Upon renewal, a new license key will be issued and your previous key will expire.
3.2 License Key
A unique license key is issued to you upon purchase. This key:
- Is for your personal use only and may not be shared, sold, or transferred
- May be activated on a single device at a time
- Will expire at the end of your subscription period
3.3 Free Trial
We may offer a free trial period (currently 14 days) that allows you to use the full Software without charge. The free trial:
- Is limited to one trial per device
- Does not require a credit card
- Expires automatically after the trial period
- May not be used repeatedly on the same machine
4. Restrictions
You must not:
- Copy, reproduce, or distribute the Software or any portion of it
- Sell, sublicense, rent, lease, or lend the Software or your license key to any third party
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software
- Modify, adapt, translate, or create derivative works based on the Software
- Remove, alter, or obscure any proprietary notices in the Software
- Use the Software for any unlawful purpose or in violation of any applicable law
- Circumvent or attempt to circumvent any license verification or copy protection mechanism
- Share your license key with others or use it on more than one device simultaneously
5. Ownership and Intellectual Property
The Software, including all code, graphics, user interface designs, and documentation, is and remains the exclusive property of TNKR. This Agreement does not transfer any intellectual property rights to you. All rights not expressly granted are reserved by the Licensor.
6. Updates and Support
During an active subscription period, you are entitled to receive software updates as they are made available. Updates are provided at the Licensor's sole discretion and this Agreement applies to all updates.
Basic support is available via email at support@sportsvideobasic.com. We will make reasonable efforts to respond to support inquiries but do not guarantee response times or resolution.
7. Refunds and Cancellation
Refund requests may be made within 14 days of your initial purchase by contacting us at support@sportsvideobasic.com. Refunds are issued at our discretion.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for the remaining period after cancellation.
Free trial users are not entitled to a refund as no charge is made.
8. Disclaimer of Warranties
The Software is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Software will be error-free, uninterrupted, or free of harmful components. You use the Software at your own risk.
Nothing in this clause limits any rights you may have under applicable consumer protection laws that cannot be excluded by agreement.
9. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall TNKR be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or in connection with your use of the Software.
Our total liability to you for any claim arising under this Agreement shall not exceed the amount you paid for the Software in the twelve (12) months preceding the claim.
10. Termination
This Agreement is effective until terminated. It will terminate automatically if you:
- Fail to pay the subscription fee when due
- Breach any term of this Agreement
- Cancel your subscription
Upon termination, you must stop using the Software and delete all copies in your possession. Sections 5, 8, 9, and 11 survive termination.
11. Governing Law
This Agreement is governed by the laws of Australia. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Australia.
If you are a consumer in a jurisdiction with mandatory consumer protection laws, those laws may give you rights in addition to those set out in this Agreement.
12. Changes to This Agreement
We reserve the right to update this Agreement at any time. We will notify you of material changes by posting the updated Agreement on our website or via email. Your continued use of the Software after such notice constitutes acceptance of the updated terms.
