Privacy Policy

1. Overview

TNKR (ABN 51 658 895 947) ("we", "our", or "us") operates the website sportsvideobasic.com and the Sports Video Basic desktop application (the "App"). This Privacy Policy explains what information we collect, how we use it, and your rights regarding that information.

The App is designed to work entirely on your local machine - your video files, projects, and tagged footage never leave your device unless you choose to export and share them.

We handle personal information in line with the Australian Privacy Principles in the Privacy Act 1988 (Cth) and, for people in New Zealand, the Information Privacy Principles in the Privacy Act 2020 (NZ). This policy explains:

• what personal information we collect, and how
• why we collect, use and share it
• when we send marketing emails, and how to unsubscribe
• which overseas countries your information may be sent to
• how to access or correct your information
• how to make a privacy complaint, and how we deal with it

2. Information We Collect

2.1 License Activation

When you activate a license key, the App sends the following to our licensing provider (Lemon Squeezy):

• Your license key
• Your device's name (its "hostname"), used as a label so you can tell your activations apart. Device names often include the owner's name, such as "SAMS-LAPTOP".

Lemon Squeezy then gives the App a unique instance ID for that device.

After that, each time the App starts while you're online, it re-checks your license by sending your license key and that instance ID. If you're offline, the App keeps working for up to 7 days after its last successful check.

No other device information is collected or transmitted during activation or verification. The App does not collect or transmit your video files, project data, or any usage data.

2.2 Information Stored on Your Device

The App keeps the following on your device only - none of it is sent to us:

• Your license details (in an encoded file)
• A marker recording that a free trial has been used on this device. It stays after the trial ends, so that the same device can't start a second free trial.
• Thumbnails of your videos, shown in the App's media bin and timeline
• A copy of the latest release notes, and the version you last used

These are kept in the App's data folder (%APPDATA%\sports-video-basic on Windows, ~/Library/Application Support/sports-video-basic on Mac) and your temporary files folder. They are not removed automatically when you uninstall the App; you can delete these folders yourself at any time. Your projects (.svb files) are saved wherever you choose.

2.3 Payment Information

All payment processing is handled by Lemon Squeezy. We do not collect or store your credit card details. When you make a purchase, your payment information is processed directly by Lemon Squeezy under their own privacy policy, available at lemonsqueezy.com/privacy.

Lemon Squeezy may collect your name, email address, and billing address at checkout in order to process your payment and send you a receipt and license key.

Lemon Squeezy then sends us your name, email address, the product you chose, and your newsletter choice, so we can send you your trial emails, or stop them once you buy (see section 4).

2.4 Trial and Purchase Form

When you start a free trial or click "Buy Now" on our website, a short form asks for:

• Your name and email address
• Whether you want our newsletter (the box starts unticked)
• Your agreement to our EULA and this Privacy Policy, with the time you agreed

The form passes these to Lemon Squeezy's checkout, so your details are filled in for you. We use your name and email to send your license key and the emails described in section 4.

2.5 Website

When you visit our website, our hosting provider's (Netlify's) standard server logs may record your IP address, browser type, and pages visited. This information is used only for diagnosing technical issues and is not sold or shared with third parties for marketing purposes.

Our pages also load content from other services, which receive your IP address and browser details when a page loads:

• Google Fonts, for the website's fonts
• Tailwind CSS, for the website's styling
• Lemon Squeezy's checkout script, which runs the checkout and may set cookies to do so
• ipapi.co and Frankfurter, to show prices in your local currency
• Cloudflare Web Analytics, to count visits to the website (see below)

To make prices load faster, the currency detected for you is saved in your browser's local storage. You can clear this, and any cookies, in your browser settings.

Website analytics. We use Cloudflare Web Analytics to understand how our website is used, such as which pages are visited and how quickly they load. When a page loads, it sends Cloudflare the page address, the page you came from (the referrer), your browser, operating system and device type, your approximate country (worked out from your IP address), and page-load timings. Cloudflare Web Analytics does not use cookies or local storage, and does not track you across websites or build a profile of you. We see only combined statistics, such as the number of visits to each page, not information about individual visitors. Analytics runs on our website only - the App does not collect usage data.

2.6 Emails and Support

If you contact us for support, we collect the information you provide in your message (such as your email address and description of the issue). This is used solely to respond to your inquiry.

Our email service, Sender, may record whether you open our trial and newsletter emails and which links you click. We use this only to see which emails are useful.

3. How We Use Your Information

We use the information collected for the following purposes:

• To activate and validate your license
• To deliver software updates
• To respond to support requests
• To maintain the security and integrity of the licensing system
• To prevent fraud and misuse - for example, stopping the same device from starting more than one free trial
• To understand how our website is used, and improve it
• To send you emails about your free trial, and newsletters if you ask for them, until you unsubscribe (see section 4)
• To comply with our legal obligations, and to enforce our EULA
• If our business, or part of it, is sold or transferred, to pass your information to the new owner, who must continue to protect it in line with this policy

We do not sell your information, and we do not use it for advertising profiling. We use it only for the purposes above, and for related purposes you would reasonably expect.

4. Marketing Emails

If you start a free trial, we will send you a short series of emails about it, such as how to get started, tips for using the App, a reminder before your trial ends, and offers to buy a license. These stop when you buy a license.

We will only send you our newsletter, with coaching tips and news about new features, releases and offers, if you ask for it by ticking "Send me coaching tips and Sports Video Basic updates" when you start a trial or buy a license.

Every marketing email identifies us and includes an unsubscribe link. You can unsubscribe at any time using that link, or by emailing support@sportsvideobasic.com, and we will stop within 5 business days. Unsubscribing does not affect emails we need to send about your purchase or license, such as receipts and license keys.

5. Data Storage and Security

We take reasonable steps to protect the personal information we hold from misuse, loss and unauthorised access. We keep it in these places:

• Lemon Squeezy - your orders, license keys and activations, under their privacy policy
• Sender - your name, email address, and which emails you're signed up for (trial emails, newsletter, customer), until you unsubscribe or ask us to delete them
• Our email (Google) - messages you send us, for as long as we need them to help you and deal with any follow-up
• Your own device - your license file and the other items in section 2.2

Order details from Lemon Squeezy pass through a small program we run on Cloudflare, which adds you to the right list in Sender. It does not keep a copy.

If a data breach is likely to cause you serious harm, we will tell you as soon as practicable, along with the regulator where the law requires it (the OAIC in Australia, or the Privacy Commissioner in New Zealand).

7. Disclosure Overseas

The services listed in section 6 are run by companies based outside Australia, so personal information we collect - or that they collect for us - is likely to be sent to and stored in other countries. These are mainly the United States (Lemon Squeezy, Cloudflare, Google, Netlify, GitHub) and the European Union (Sender), and may also include other countries where these providers operate data centres.

Some of these countries may have privacy laws that are less protective than Australia's or New Zealand's. We only use established providers that publish their own privacy policies, and we share only the information they need to provide their service.

8. Your Rights

Depending on your location, you may have rights including:

• The right to access information held about you
• The right to request correction or deletion of your data
• The right to withdraw consent where processing is based on consent

To exercise any of these rights, please contact us at support@sportsvideobasic.com. We will respond within 30 days (within 20 working days if you are in New Zealand), and we do not charge for this. For payment records held by Lemon Squeezy, you can also contact them directly.

9. Complaints

If you think we have mishandled your personal information, or breached the Australian Privacy Principles, please email the details to support@sportsvideobasic.com with "Privacy complaint" in the subject line.

When we receive a complaint, we will:

• acknowledge it within 7 days, and ask for any further information we need
• look into what happened and whether we breached the Australian Privacy Principles
• tell you the outcome, and what we will do about it, within 30 days where possible - if a complaint is complex and needs longer, we will let you know and agree a new timeframe with you
• fix any breach we find as soon as reasonably practicable

If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au. If you live in New Zealand, you can complain to the Office of the Privacy Commissioner at privacy.org.nz. If you live elsewhere, you may be able to complain to the privacy or data-protection authority where you live.

10. Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be posted on this page with a new version number and publication date. If a change means we will use your information in a new way, we will email you before it takes effect.
